User Agreement & Terms of Service

LEGAL NOTICE: This User Agreement ("Agreement") is a legally binding contract between you ("User", "you", or "your") and GetJob.us ("Company", "we", "us", or "our"). By accessing, browsing, or using our website located at getjob.us (the "Website" or "Service"), you acknowledge that you have read, understood, and agree to be bound by all terms and conditions contained herein. If you do not agree to these terms, you must immediately discontinue use of the Website and may not access or use any of our services.

1. Acceptance of Terms and Modifications

This Agreement governs your access to and use of GetJob.us, including all content, functionality, and services offered on or through the Website. By accessing or using the Website, you accept and agree to be bound by the terms and provisions of this Agreement, our Privacy Statement, and all applicable laws and regulations.

We reserve the right, at our sole discretion, to modify, amend, or replace this Agreement at any time. Material changes will be effective immediately upon posting on the Website, and we will make reasonable efforts to notify users of material changes via email or prominent notice on the Website. Your continued use of the Website after any such modifications constitutes your acceptance of the modified Agreement. If you do not agree to the modified terms, you must stop using the Website immediately.

This Agreement may be supplemented by additional terms and conditions specific to particular services, features, or promotions ("Additional Terms"). In the event of a conflict between this Agreement and any Additional Terms, the Additional Terms shall prevail with respect to the specific service, feature, or promotion to which they apply.

2. Eligibility and Account Registration

2.1. Age and Capacity Requirements

You must be at least 18 years of age to use this Website. By using the Website, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this Agreement. If you are using the Website on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind such entity to this Agreement.

The Website is not intended for use by individuals under the age of 18. If we become aware that we have collected personal information from a child under 18, we will take steps to delete such information in accordance with applicable law, including the Children's Online Privacy Protection Act (COPPA).

2.2. Account Registration and Security

Certain features of the Website may require you to create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information to keep it accurate, current, and complete
  • Maintain the security and confidentiality of your password and account credentials
  • Accept all responsibility for all activities that occur under your account, whether authorized or not
  • Notify us immediately of any unauthorized use of your account or any other breach of security
  • Not share your account credentials with any third party
  • Not create multiple accounts to circumvent restrictions or limitations

You are solely responsible for maintaining the confidentiality of your account and password. We are not liable for any loss or damage arising from your failure to comply with this section. We reserve the right to suspend or terminate your account if we suspect any unauthorized access or violation of this Agreement.

3. Description of Service and Third-Party Content

GetJob.us operates as a job aggregator platform that collects, organizes, and displays job listings from various third-party sources across the United States. Our Service provides users with the ability to:

  • Browse and search job listings by location, state, category, and industry
  • View detailed information about job opportunities, including job descriptions, requirements, and application instructions
  • Post job listings (subject to separate terms, conditions, and fees)
  • Access job-related resources and information

Important: GetJob.us is an aggregator service. We do not directly employ individuals, and we are not responsible for the hiring decisions, employment practices, or terms and conditions of employment offered by employers whose job listings appear on our Website. We are not a party to any employment relationship that may result from your use of our Service.

Job listings are provided by third parties, and we do not verify, endorse, or guarantee the accuracy, completeness, or validity of any job listing, employer information, or employment opportunity. We are not responsible for the content, accuracy, or availability of third-party websites linked from our Service.

4. User Conduct and Acceptable Use Policy

4.1. Prohibited Activities

You agree not to use the Website in any way that violates any applicable federal, state, local, or international law or regulation, or for any unlawful purpose. Specifically, you agree NOT to:

  • Post false, misleading, fraudulent, or deceptive job listings or information
  • Post job listings that discriminate on the basis of race, color, religion, sex, national origin, age, disability, genetic information, or any other protected characteristic under applicable law, including Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act (ADA), and the Age Discrimination in Employment Act (ADEA)
  • Post job listings for illegal activities or positions that violate applicable employment laws
  • Use automated systems, bots, scrapers, or crawlers to access, collect, or extract data from the Website without our express written permission
  • Attempt to gain unauthorized access to any portion of the Website, other accounts, computer systems, or networks connected to the Website
  • Transmit any viruses, malware, Trojan horses, worms, or other harmful or malicious code
  • Interfere with or disrupt the Website, servers, or networks connected to the Website
  • Harass, threaten, abuse, defame, or otherwise harm other users or third parties
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
  • Collect or store personal data about other users without their express consent
  • Use the Website for any commercial purpose not expressly authorized by us
  • Reverse engineer, decompile, or disassemble any portion of the Website
  • Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices

4.2. Job Posting Requirements

If you post job listings on our Website, you agree to comply with all applicable employment laws, including but not limited to:

  • Fair Labor Standards Act (FLSA) regarding minimum wage and overtime
  • Equal Employment Opportunity (EEO) laws prohibiting discrimination
  • State and local employment laws and regulations
  • Truth in advertising laws and regulations

You represent and warrant that all job listings you post are for legitimate employment opportunities and that you have the authority to post such listings on behalf of the employer.

5. Intellectual Property Rights

5.1. Our Intellectual Property

The Website and its entire contents, features, and functionality, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the selection and arrangement thereof (collectively, the "Content"), are owned by GetJob.us, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The trademarks, service marks, and logos (the "Trademarks") used and displayed on the Website are registered and unregistered Trademarks of GetJob.us and others. Nothing on the Website should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on the Website without our written permission or the permission of the third party that may own the Trademark.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website without our prior written consent, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials
  • You may store files that are automatically cached by your web browser for display enhancement purposes
  • You may print or download one copy of a reasonable number of pages of the Website for your own personal, non-commercial use and not for further reproduction, publication, or distribution

5.2. Digital Millennium Copyright Act (DMCA)

We respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, we will respond to clear notices of alleged copyright infringement. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information:

  • A physical or electronic signature of a person authorized to act on behalf of the copyright owner
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material
  • Your contact information, including address, telephone number, and email address
  • A statement that you have a good faith belief that use of the material is not authorized by the copyright owner
  • A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner

  • The General Data Protection Regulation (GDPR) for users in the European Economic Area
  • The California Consumer Privacy Act (CCPA) for California residents
  • The Children's Online Privacy Protection Act (COPPA)
  • Other applicable state and federal privacy laws

7. Disclaimers of Warranties

THE WEBSITE AND ALL CONTENT, INFORMATION, PRODUCTS, AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE WEBSITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, GETJOB.US, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS (COLLECTIVELY, THE "GETJOB.US PARTIES") EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WARRANTIES THAT THE WEBSITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
  • WARRANTIES THAT THE WEBSITE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR CURRENCY OF ANY CONTENT, INFORMATION, OR JOB LISTINGS
  • WARRANTIES THAT DEFECTS WILL BE CORRECTED OR THAT THE WEBSITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE GETJOB.US PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR USE OR INABILITY TO USE THE WEBSITE
  • ANY ERRORS OR OMISSIONS IN THE CONTENT OR JOB LISTINGS
  • ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN
  • ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE WEBSITE
  • ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH THE WEBSITE BY ANY THIRD PARTY
  • ANY EMPLOYMENT DECISIONS MADE BY EMPLOYERS BASED ON JOB LISTINGS DISPLAYED ON THE WEBSITE
  • ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE WEBSITE

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF THE GETJOB.US PARTIES FOR ANY CLAIMS UNDER THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, FOR ACCESSING THE WEBSITE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

9. Indemnification

You agree to defend, indemnify, and hold harmless the GetJob.us Parties from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

  • Your use of and access to the Website
  • Your violation of any term of this Agreement
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right
  • Any claim that your User Content (as defined below) caused damage to a third party
  • Any employment relationship or dispute arising from your use of job listings on the Website

This defense and indemnification obligation will survive this Agreement and your use of the Website. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

10. User Content and License Grant

10.1. User Content

"User Content" means any content, including but not limited to text, images, graphics, videos, job listings, comments, feedback, and other materials, that you submit, post, or display on or through the Website.

You retain all ownership rights in your User Content. However, by submitting, posting, or displaying User Content on or through the Website, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Website and our business, including without limitation for promoting and redistributing part or all of the Website (and derivative works thereof) in any media formats and through any media channels.

10.2. User Content Representations

You represent and warrant that:

  • You own or have the necessary licenses, rights, consents, and permissions to use and authorize us to use your User Content as contemplated by this Agreement
  • Your User Content does not and will not infringe, violate, or misappropriate any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right
  • Your User Content does not contain any libelous, defamatory, obscene, pornographic, abusive, or otherwise offensive material
  • Your User Content complies with all applicable laws and regulations

11. Termination

We may terminate or suspend your access to the Website immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach this Agreement. Upon termination, your right to use the Website will immediately cease.

If you wish to terminate your account, you may simply discontinue using the Website or contact us to request account deletion. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

We reserve the right to remove or refuse to post any User Content for any or no reason in our sole discretion. We also reserve the right to take any action with respect to User Content that we deem necessary or appropriate in our sole discretion, including if we believe that such User Content violates this Agreement, infringes any intellectual property right or other right of any person or entity, threatens the personal safety of users of the Website or the public, or could create liability for us.

12. Dispute Resolution and Arbitration

12.1. Binding Arbitration

Except for disputes that qualify for small claims court, all disputes arising out of or related to this Agreement or any aspect of the relationship between you and GetJob.us, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, will be resolved through final and binding arbitration before a neutral arbitrator instead of in a court by a judge or jury, and you agree that GetJob.us and you are each waiving the right to trial by a jury.

You agree that any arbitration under this Agreement will take place on an individual basis; class arbitrations and class actions are not permitted, and you are agreeing to give up the ability to participate in a class action.

12.2. Arbitration Rules and Procedures

The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (the "AAA Rules"), as modified by this Agreement. The AAA Rules are available atwww.adr.orgor by calling the AAA at 1-800-778-7879.

The arbitrator will have exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this binding arbitration agreement, except that a court has the authority to determine whether a dispute is within the scope of this arbitration provision.

12.3. Exceptions to Arbitration

Notwithstanding the foregoing, you and GetJob.us each retain the right to bring an individual action in small claims court and the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

13. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Notwithstanding the arbitration provision above, any disputes not subject to arbitration shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Website or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.

14. Export Control and International Use

The Website is controlled and operated from the United States. We make no representation that materials on the Website are appropriate or available for use in other locations. Those who choose to access the Website from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.

You may not use or export or re-export the Website or any portion thereof, or any software available on or through the Website, in violation of the export control laws and regulations of the United States. You represent and warrant that you are not located in, under the control of, or a national or resident of any country to which the United States has embargoed goods or services.

15. Severability and Entire Agreement

If any provision of this Agreement is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of this Agreement will remain in effect. The invalid or unenforceable provision will be replaced with a valid provision that comes closest to the intent underlying the invalid or unenforceable provision.

This Agreement, together with our Privacy Statement and any Additional Terms, constitutes the entire agreement between you and GetJob.us regarding our Website and supersedes all prior and contemporaneous written or oral agreements between you and GetJob.us.

16. Waiver and Assignment

No waiver by GetJob.us of any term or condition set forth in this Agreement shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of GetJob.us to assert a right or provision under this Agreement shall not constitute a waiver of such right or provision.

You may not assign or transfer this Agreement, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer this Agreement without such consent will be null and void. We may freely assign or transfer this Agreement without restriction. Subject to the foregoing, this Agreement will bind and inure to the benefit of the parties, their successors, and permitted assigns.

Any notices required or permitted under this Agreement shall be in writing and shall be deemed given when delivered personally, sent by certified or registered mail, return receipt requested, or sent by overnight courier service to the address above, or when sent by email to the email address provided in your account or to admin@getjob.us.

ACKNOWLEDGMENT: BY USING GETJOB.US, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS USER AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE OUR WEBSITE. YOUR USE OF THE WEBSITE CONSTITUTES YOUR ACCEPTANCE OF THIS AGREEMENT.
